Family to sue WA Health Department after daughter dies in hospital

The heartbroken parents of a seven-year-old girl who died in a Perth hospital are set to launch legal action against Western Australia's Health Department.

Aishwarya Aswath died at Perth Children's Hospital in April after waiting two hours in the emergency department with a temperature of 38.8 degrees.

The following month a report found staff did not correctly identify signs of sepsis.

Aishwarya Aswath's family are set to launch legal action against the WA health department.

"If someone had fought like us in the past, I'd probably have my daughter with me," Aswath Chavittupara, Aishwarya's father, said.

Aishwarya's family hopes to use any potential payout to ensure others don't suffer.

"The family's been very clear that any moneys are received from that will go back into trying to honour the memory of Aishwarya," family spokesperson Suresh Rajan said.

"For us the most important thing would be to build a hospital, we want to go in that direction," Mr Chavittupara said.

But before Aishwarya's family can move forward with those plans, they're awaiting the findings of another external report, with hopes it will provide more answers around how this tragedy could have happened.

Aishwarya died at Perth Children's Hospital in April after waiting two hours in the emergency department.

That report is due to be released to the Health Department within days.

This looming compensation claim set to be another blow for WA's already embattled health system.

"We haven't received any claim as yet... it's a difficult situation and the pain will go one forever for that family you'd expect... obviously we'd consider it if anything arrives," WA Premier Mark McGowan said.

Aishwarya's death is also expected to be the subject of a coronial inquest.

"Fighting for a cause and trying to build something for the society, that might keep us going," Mr Chavittupara said.
